LPA grants variance reducing industrial buffer for storage site amid debate over precedent and zoning options

Baker County's Local Planning Agency approved a project‑specific variance to reduce the county's 150‑foot industrial buffer requirement for a proposed commercial storage facility at the northeast corner of State Road 121 and County Road 228.

LaDonna, the planning director, described the parcel as 2.07 acres with residential zoning on three sides and explained that strict industrial buffering would leave little usable area. "Staff does recommend approval of the reduction in buffer with adding the commercial buffer requirement...maintaining a 6 foot in height buffer of vegetation, fencing, or walls on those residential sides," she said, and emphasized the variance would be project‑specific and void if the use changed to industrial.

Commissioners debated whether changing the zoning to commercial would be a better long‑term option, and some expressed concern the proposed reduction (to roughly 30 feet on one side in one scenario) would represent an 80% decrease from the code requirement and could be inconsistent with variance criteria intended to preserve the general intent of the code.

Applicant representatives said they wanted to retain industrial entitlement to avoid restrictions on what could be stored and to preserve flexibility for commercial tenants. After discussion, the board moved and approved the variance by voice vote; staff and commissioners noted additional site‑plan limitations and a requirement that the reduced buffer not be exceeded without returning to the board.
