Counsel cited Indiana Code 5-22-22-6 governing private sales of surplus property and recommended declaring items surplus, setting a per-unit floor price, and limiting the aggregate credited sale value so the transaction complies with statute and avoids unintended procurement issues.
Board members discussed pricing scenarios and a statutory $5,000 aggregate threshold for private sales. The board agreed on a floor price approach (transcript discussion suggested $60 per unit as a floor) and moved to declare the listed containers surplus and authorize a private sale under IC 5-22-22-6 with a floor price and credit application to the outstanding invoice. The motion carried unanimously.
Counsel noted the declaration of surplus does not obligate immediate disposition of every container; the board can sell a portion now and retain or later sell the remainder.
Next steps: staff will finalize the inventory, confirm exact units to be sold, document the floor price and aggregate credit amount, and execute the private-sale paperwork in line with statutory requirements.
