Warrick County board conditionally approves release of Lexington subdivision security

Jordan Eichner, an engineer with Eichner Engineering, asked the Warrick County Drainage Board on Oct. 23 to accept drainage and streets for the Lexington subdivision and to consider a contingent approval to avoid repeated return visits. "I would request that we would get that accepted both for this board and the commissioners," Eichner said, urging the board to allow acceptance subject to field completion.
Board members described a history of partial construction and bank takeover after the original developer defaulted, and noted several lingering drainage punch-list items — chiefly a few end sections and an undersized inlet. Staff reported recent county inspections and said most pipes are in good shape but a few repairs remain. Eichner said the developer performed additional camera inspection work and asked the board for a single contingent acceptance pending completion of agreed corrections.
The board agreed that the developer and surveyor must finish and verify agreed-upon modifications no later than Nov. 24. "It would be approved today subject to the completion of the agreed upon renovations by November 24," one board member said during discussion. Stacy moved to release the security contingent upon those modifications; Sarah seconded the motion. The board voted in favor.
The motion requires a surveyor’s report and verification of the field corrections before the board will finalize release of the letter-of-credit or other guarantee. If the Nov. 24 deadline is missed, the board will re-evaluate the item at a subsequent meeting. The board also discussed records retention and asked staff to include inspection documentation in Dennis’s file so future questions about original construction and maintenance responsibilities are documented.
