Warrick County’s Board of Zoning Appeals on Nov. 25 approved a variance allowing landscape material storage bins with walls taller than standard fence height and a reduced front setback at 3644 Asbury Cemetery Road.
Staff described the proposal as open-storage walls of 5 feet and covered storage walls of 10 feet, with a roof that converts the bin into a structure subject to the 25-foot front setback. The applicant (recorded in the hearing as Chris Combs) said he has operated in the area since 1998, that seven of nine adjacent property owners signed notices acknowledging the project, and that the structure is used to store topsoil and mulch to enable work during wet weather. He told the board landscapings and evergreen screening have been added around the structure to reduce visual impacts.
Board members and staff discussed whether a building permit was required; testimony indicated the building commission had initially said a permit was not needed but that the addition of a roof made the feature a structure and thus triggered setback review. The board approved the variance after reciting the required findings and attached standard permit conditions: improvement-location permit, building permit, compliance with Warrick County zoning, and required utility easements. Staff said approval paperwork would be ready next week.
