Commissioners voted to intervene in litigation over Alabama’s simplified sellers use tax (SSUT) after county staff described a recommendation from association counsel to join the Department of Revenue’s defense.
Scott (Speaker 9) told the commission that “the city of Tuscaloosa has filed a lawsuit against the Department of Revenue challenging the, simplified sellers use tax.” He said ACCA counsel recommended counties pass a resolution to intervene and “advocate for the continued, collection of the SSUT.” The resolution would make the county a party to the case in support of the Department of Revenue.
Commission members discussed timing and coordination with nearby municipalities; Speaker 5 said he expected other towns to pass similar resolutions and urged commissioners with towns in their districts to pursue local adoption. A motion to adopt the resolution to intervene was made and seconded and carried without further amendment.
