BPPE advances three regulatory packages and outlines sunset-review timeline

Parker, presenting the bureau's regulations tracker, said the minimum operating-standards/refund-policies package was submitted to the Office of Administrative Law on Oct. 6, 2025. He summarized three 2025 regulatory packages in progress: unapproved activity, catalog requirements, and approval by means of accreditation.
On unapproved activity, Parker said the bureau removed a $10,000 minimum fine from proposed section 75030(b)(1) and added an explicit aggravating/mitigating factor (75030(b)(2)(f)) to the list of factors considered when issuing citations under the cited enforcement authority.
On catalog requirements, Parker described changes to disclosure timing (allowing clearly labeled catalog updates rather than mandatory annual replacements), additions to address distance-education learning-management systems and digital storage, and language requiring institutions to disclose off-site record locations.
On accreditation-related approvals, Parker said the bureau removed ownership-level requirements from certain subsections, clarified the scope of accreditation, and added record-location reporting requirements for off-site records.
During public comment Damon Fugit of DeHart Technical School asked for a clear publication timeline for the packages so institutions and accreditors can map updates into catalogs. Parker and staff acknowledged the request and noted notices of effective packages will be posted to the bureau's regulatory mailing list and website.
Ryan Thatcher from the DCA legislative office provided an overview of the sunset-review process: a bureau-prepared sunset report will be reviewed by agency and the governor's office, a background paper and written responses will follow (late Feb–April), a sunset hearing typically occurs in March, and a sunset bill (often introduced as a "spot" bill in mid/late February) will be developed and may receive substantive amendments later in the spring.
