Attorney Jack Rice for the respondent raised evidentiary objections to some aerial photographs and indicated he would pursue either a development application or a residential enterprise pathway. The town and the respondent agreed to a mutually acceptable continuance to allow the owner to submit the necessary paperwork and to discuss screening and agricultural exemptions where applicable.
Magistrate Barnard granted the continuance and reset the violation hearing to April 6, 2026, at 9 a.m. The town was directed to maintain the case file in its current form for any future hearing. The magistrate entered the town’s evidentiary case file as composite exhibit 1 over objection and admitted respondent exhibit R‑2 (a statutory copy) without objection.
