The special magistrate found PBP Investment LLC in violation of town fence provisions after the town presented photographs and evidence that sections of a wooden fence surrounding 4.98 acres at 392 F Road had fallen into disrepair.
Code Compliance Officer John Suarez told the magistrate the notice of violation and notice of hearing had been posted and mailed in mid‑October, and that a prior case involving an earlier section of the fence had been opened in August 2025 and complied with. No respondent appeared at the hearing.
Magistrate Amity Barnard ruled that the respondent was in violation of the cited code sections and ordered the property owner to remove or repair the fence on or before Dec. 15, 2025, or face a $150 per day fine until compliance. The magistrate also assessed administrative costs for the hearing in the amount of $234.05 and set a fine‑assessment hearing for Jan. 5, 2026, if the respondent does not comply.
The magistrate noted the code section cited in the notice is targeted at keeping animals contained and suggested the town staff consider using a more general fence provision in future cases when animals are not present.
Next steps: the town will post the signed order to the property and pursue fine assessment if the owner fails to comply by the December deadline.
