Hearing Officer Stacy Shulman continued an administrative hearing in Department of Public Health v. Elizabeth Kittleson (petition no. 2025-337) after discovering the notice sent to parties listed the wrong start time.
At 09:03 a.m., Shulman told those present she had reviewed documents intended for the record and found “the notice of hearing that was disseminated to the parties indicates that this hearing, was to take place at 9PM as opposed to 9AM.” The Department of Public Health was on the record; the respondent, Elizabeth Kittleson, a registered dental hygienist, was not present.
The officer said she and counsel for the petitioner reviewed available dates and that the matter would be continued. After a brief correction of the initially stated date, Shulman set the new hearing date as Dec. 4, 2025, at 8:30 a.m., and said notifications would be sent to all parties that day. Attorney Joel Newton was present for the Department and was thanked for his flexibility.
Shulman also noted that Kittleson is under a summary suspension. The record for the session was closed at the end of the proceeding.
What happens next: The hearing is rescheduled for Dec. 4, 2025, at 8:30 a.m., and the parties will be notified. No substantive testimony or contested evidence was taken at this session, and no formal vote or oral rulings on the merits were made.
