The City Planning Commission on Tuesday approved a planned unit development (ZN8725) on State Highway 361 that would allow 99 single‑family homes, 32 townhouses and six common lots, including proposed beach access, as part of a larger Mustang Island development.
Assistant Director Andrew Demas, who presented the case, said in the meeting packet and slides that “the proposed planned unit development will be which is 99 single family homes. You have 32 townhouses and 6 common lot areas” and that staff had found the request consistent with the city comprehensive plan, unified development code and the area development plan. Staff recommended approval.
Several nearby property owners and condo representatives raised objections during the public hearing. William Summers said he and other residents “just found out this was going on today” and questioned the notice and the plan’s effects on traffic and the local bird habitats. Philip Tinsley, speaking for 21 Lost Colony owners, asked for more time to study the proposal and learn how it would affect their properties. Neighbors repeatedly raised concerns about runoff and flooding, citing past drainage problems; Debbie Hicks said her neighborhood had previously spent about $350,000 to address drainage and said she feared new development would cause renewed flooding.
In response, Demas said infrastructure questions will be addressed during platting and permitting. He told the commission that stormwater must be mitigated on site and that “state law says you cannot discharge any runoff from your property onto adjacent property.” He also said TxDOT controls access to State Highway 361 and may require an access or traffic analysis as part of any driveway or private road permit.
Neighbors also pressed about beach access in the plan and whether it would be public. Demas said beach access, utilities and dune protection will be handled at the plat stage and through county dune‑protection processes; he cautioned that a PUD establishes land use but does not finalize infrastructure details.
Commissioners noted that any zoning action here still goes to City Council for final approval. After discussion and the standard public‑hearing process, a motion to approve the PUD as presented carried with recorded aye votes.
The project will return to the commission and city staff during platting and permitting, when final plans for drainage, utilities, traffic and any beach access will be evaluated and required mitigation measures set.
