Ari Goldberg of the law firm Barclay Damon, representing the applicant, told the board the proposal had undergone review by the planning board and environmental advisory committee and that the Erie County Department of Environment and Planning, the town Department of Public Works and the New York State Department of Transportation had reviewed the site plan. "The traffic committee has signed off," Goldberg said, and he noted a queuing analysis from Carmina Wood Design had received rigorous review.
Anthony Pandolfi of Carmina Wood Design accompanied the applicant. Goldberg also identified a plaza ownership representative as participating in prior meetings and said plaza ownership had approved the stacking lane design for the drive-through. The board solicited public comment; no members of the public signed up to speak on the project at either hearing and the board closed both hearings by motion and vote.
No final decision on the special use permit or the rezoning was recorded in the meeting minutes provided; the hearings provided the public opportunity to comment and closed without public opposition.
