ZBA approves variances for lot split at 430/432 **** Road despite neighbor objections

The Cheektowaga Zoning Board of Appeals approved variances needed to split a parcel containing two buildings at 430/432 **** Road on Nov. 19, allowing separate ownership of the two structures.
Attorney Mark Romanowski, representing owner Peter Hunt, told the board the requested relief stems from creating two legal parcels between two existing buildings and that no physical changes to the buildings or the site are proposed. Romanowski said the sale of one building to a law firm is contingent on variance approval and that the existing drive/access points and building footprints will remain unchanged.
Neighbors objected to what they described as changes in neighborhood character and the removal of a prominent tree near the site. Romanowski replied the tree had been removed because it was dying and reiterated that the application does not call for further physical modification to the property.
After discussion, the board voted to grant the variances. The vote included at least one recorded no vote (Miss Wertzak) while other board members voted in the majority to approve the subdivision relief. The board’s approval legalizes the proposed lot line configuration; any future physical changes would still require applicable building permits and reviews.
