The planning board tabled action on a proposed ~53,000 sq ft commercial tire storage and service building at 3419 Broadway after learning a prior negative declaration had been rescinded and the NYS DEC requested additional materials; the applicant provided a SHPO no‑impact letter and wetland work is underway.
The Cheektowaga Planning Board on Nov. 26 tabled consideration of a proposal to merge three parcels and build an approximately 53,000‑square‑foot commercial tire storage and servicing building at 3419 Broadway until the board’s December meeting.
Board members said a negative declaration tied to an earlier use variance had been rescinded by the town board and that the New York State Department of Environmental Conservation submitted comments on Oct. 27 requiring additional information. The applicant has since provided a letter from the State Historic Preservation Office saying the project would have no impact and a wetland delineation, and the applicant said additional sewer‑discharge materials are forthcoming.
The applicant’s virtual representative, Mr. Tiller, asked whether the DEC 90‑day review must be awaited. “So we may be tabled for a little bit because, you know, I heard that they were behind,” Mr. Tiller said, noting the agency’s processing delay could affect the schedule. Board members agreed that the DEC findings and recent submittals should be circulated for review before returning the item to the agenda.
A motion to table the item until December passed by voice vote. The chair said the applicant should receive notice when the project is scheduled to reappear on the December agenda.
