The council accepted a verified petition to put Ordinance No. 746, a rezoning to GB for property on Park Avenue, before voters and set the election for the municipal election on Nov. 3, 2026.
Staff told the council the petition required 394 signatures and that 399 were submitted. Speaker 2 said, “They were required to have 394 signatures. They've submitted 399.” Councilors discussed statutory timing and options under state election law, and legal counsel explained that the governing body could order a special election within a statutory window or wait to place the question on the next municipal election.
Councilors weighed the timetable, administrative burden and cost. When asked “How much is a special election, Brian?” Speaker 3 replied, “$3,500 roughly.” After discussion, a motion to accept the petition and schedule the ordinance for the municipal election date (Nov. 3, 2026) was moved, seconded and approved on a voice vote.
Council members also discussed litigation risk. Speaker 9 advised that the city was complying with the statute but cautioned that compliance does not guarantee a lawsuit would not be filed; that risk remained possible but not specified in scope. The council recorded that the ordinance had been approved previously (approved Nov. 3, published Nov. 12, effective Dec. 3) and that the petition process had met the numerical signature threshold.
Next steps: the city will place Ordinance No. 746 on the Nov. 3, 2026 municipal election ballot per the council’s action.
