Dickinson commission approves a slate of zoning, code and penalty ordinances

The Dickinson City Commission voted unanimously Oct. 21 to adopt a package of ordinances and resolutions that amend zoning and code enforcement rules and approve several land-use items.
The commission approved ordinance 18-35, a zoning-text amendment to Chapter 16 (Environment) that removes a city-level conditional-use permit requirement for oil, gas and service wells in favor of permitting those uses in agricultural (AG) and general industrial (GI) zones after approval from the North Dakota Industrial Commission. City Planner Natalie Burczyk said staff would still hold a public hearing for individual proposals, and she told commissioners staff had received no public comments on the amendment.
City Attorney (speaker 9) presented ordinance 18-36 (blighted structure penalties), ordinance 18-37 (permit penalties) and ordinance 18-38 (amendments to penalties under the International Property Maintenance Code). The attorney said the amendments are intended to clarify where penalties are located in the code and to state penalty classes (several violations are described as class B misdemeanors). No members of the public spoke on any of these ordinances during the hearings.
On land-use approvals, the commission accepted the Stockard Third final major plat (resolution 43-2025), which combines existing lots across approximately 8.27 acres to facilitate additional commercial construction, and approved a related rezoning (ordinance 18-32) to reclassify Lot 3 of Block 2 from low-density residential (R-1) to general commercial (G-C) in the extraterritorial zone. Planning and Zoning recommended approval of the final plat without conditions.
Commissioners moved and seconded the measures and recorded unanimous aye votes (Commissioners Murphy, Frederick and Doctor Bair; Chair voted aye). The measures passed without additional amendments and with no public testimony recorded at the hearings.
The commission stated staff will correct a packet reference for ordinance numbering where necessary and will replace an incorrect draft file noted during the meeting.
