Housing commission sets Dec. 10 show-cause hearing for abandoned property at 4107 Ely Road

The Housing Commission of East Ridge voted to schedule a show-cause hearing for Dec. 10 for the property at 4107 Ely Road after staff reported the site is abandoned and has multiple exterior violations.

Code enforcement told the commission the site has an overflowing dumpster and an abandoned vehicle in the driveway and that there appears to be no one living at the address. Staff said they had attempted certified and regular mail service to the property and to alternate addresses without ‘satisfactory service’ and recommended putting a show-cause hearing on the commission’s December docket to press for compliance or move toward remediation.

During discussion, staff said prior enforcement actions reached back several years and that prior officers had tried to obtain compliance, with mixed results. Staff also said they had once issued a citation and communicated directly with the owner, and that some related properties owned by the same party have previously been brought before the commission.

A motion to set a show-cause hearing for Dec. 10 was made and seconded; commissioners present voted to place the hearing on the Dec. 10 agenda. When the commission called the roll during the vote, Vice Chairperson Souder, Commissioner Myers, Commissioner Thompson, Commissioner Vallone and Chairperson Davis each recorded “yes.”

If the owner does not appear at the Dec. 10 hearing, staff said the commission will consider further action to remediate the property, beginning with exterior remediation steps. Staff also said they would attempt to contact the dumpster company and consult the file for earlier enforcement history before the hearing.

The commission did not adopt a remediation order at this meeting; the Dec. 10 show-cause hearing will be the next procedural step.
