Commission approves multiple rezones and final plats, tables Wynn Heart River rezone after valid protest

The Dickinson City Commission approved three rezoning measures and two final minor subdivision plats and tabled a fourth rezone Dec. 2 after staff said a valid protest petition had been filed.
City Planner Natalie Birchak presented the amendment to the Saint Joe’s Plaza planned-unit development (ordinance 18-41) to explicitly permit existing restaurant and limited retail uses, and to clarify that parking along 7th Street West will remain public and be maintained by the city. Birchak said staff received no public comments and recommended approval; the commission approved the ordinance after a brief public-hearing period with no speakers.
The commission also approved a zoning map amendment called Diamond First (ordinance 18-42), shifting a roughly 0.64-acre parcel from general commercial to general industrial to enable a related minor subdivision, and approved the Saks Motors rezone (ordinance 18-43) to change several lots from R-3 (high-density residential) to GC (general commercial) so the auto-sales use can expand; staff recommended the Saks Motors approval with two conditions tying it to a related subdivision and limiting future administrative lot modifications.
On plats, the commission approved the final minor subdivision for the D'Ann Wanner property (about 40 acres; resolution 52-25) to split a parcel so part could be gifted to the applicant’s grandson, and approved the 23rd Street Edition final plat (approximately 1.88 acres; resolution 53-2025) to combine lots and allow additional paved parking; staff said easements previously recorded on the property had been vacated and recommended approval.
City staff recommended tabling the Wynn Heart River 4th rezone because a protest petition submitted over the weekend appears to be valid under section 62-56(d)(3), which raises the approval threshold to a three-fourths majority. With one commissioner absent, the commission voted to table that item to the next meeting.
All rezones and plats brought to a vote that evening were approved by the commissioners present; no members of the public spoke during the hearings.
