Commission debates requiring city council to record hardship findings when overturning board of adjustment variances

Planning staff presented draft language that would require city council to consider the same determinative factors the board of adjustment uses when deciding appeals of variance denials and to make specific affirmative findings on the record before overturning a denial. The proposal followed a recent appeal in which city council granted a variance the planning board had denied.

Bridal (planning staff) explained the suggested change would insert language directing council to "consider the determining factors considered by the board of adjustment as outlined in chapter 15 24-f" and to overturn or modify a denial only if council "makes specific affirmative findings." Bridal said the change is intended to reduce instances where council action effectively rewrites ordinance requirements without documenting hardship or uniqueness.

Commissioners debated the merits and consequences of the proposal and explored alternatives, including eliminating the appeal to council entirely and directing applicants to district court. Several commissioners noted the difficulty of defining "hardship" and the risk that an undocumented council decision could set an informal precedent. One commissioner urged a joint meeting with city council to discuss the proposal before drafting ordinance amendments.

No formal ordinance change was made during the meeting; staff said they would likely discuss the concept with city council and return with suggested language and next steps. Commissioners expressed support for a further joint discussion.
