Garden City — The City Council held the second reading and approved by council action Ordinance 10-58-25, which would prohibit motorized watercraft on the Boise River within the city.
City legal advisor Wadhams updated the council on changes and said the city has coordinated with Ada County and the Boise City Attorney’s Office to pursue a uniform prohibition. He described the prohibition as drafted to be an infraction punishable by a $100 fine plus court costs and said the county may consider elevating enforcement to a misdemeanor, but that existing Idaho Code misdemeanors (such as reckless operation or property damage) already address more serious misconduct.
Wadhams also explained carve-outs in the draft ordinance for certain entities: Ada County sheriff, Garden City police, Boise City police, local fire department and their representatives and designees; the carve-outs also exempt certain county or state representatives and park system staff, but do not include HOA contractors operating on privately maintained ponds. Council President raised that some HOA ponds are fed by the Boise River and asked whether those would be covered; Wadhams said the ordinance’s applicability depends on the municipal code definition of the Boise River and that HOA activities would not automatically be exempt under the current draft language.
Council moved to read the ordinance by title only for second reading; the clerk read the summary adopting a new chapter 21 to prohibit motorized watercraft on the Boise River and to provide an effective date. The motion and second carried on a roll-call vote with all voting in favor.
What happens next: The council completed second-reading procedures and approved the ordinance language as read; enforcement approach and potential coordination with the county will be determined administratively and by any county ordinance changes.
