Planners recommend amending Dickinson code to align oil-well permitting with state law

The Dickinson Planning and Zoning Commission on Oct. 8 recommended approval of a zoning-text amendment that removes local conditional-use permit requirements for oil wells and updates city code to reference the North Dakota Industrial Commission as the permitting authority.
City planner Natalie Burczyk said the amendment to sections 16.170 and 16.174 of the Dickinson Municipal Code is intended to align local language with the North Dakota Century Code because cities lack authority to permit or deny oil wells and permitting is handled by the North Dakota Industrial Commission. “Cities do not have the authority to permit or deny oil wells,” Burczyk said during the meeting, adding that the previous related amendment (ZTA-005-2025) had replaced conditional-use language with a process that includes a public hearing before the city commission while the Industrial Commission issues permits.
No public comments were made during the hearing on the text amendment. A commissioner moved that the Planning and Zoning Commission recommend approval of ZTA-006-2025 as consistent with the comprehensive plan and zoning ordinance; the motion carried by voice vote.
The commission’s recommendation will be forwarded to the Dickinson City Commission for any required action under city procedures.
