City Attorney Wadhams introduced a resolution (12‑26‑25) and an associated policy to delegate limited authority to staff to execute and record certain easements when the city is the grantee and the easement or condition has already been reviewed by a decision maker. Wadhams said the intent is narrow — to streamline recordation of preapproved easements such as water/sewer easements, green belt/pathway easements, sidewalks/multi‑use pathway easements, public pedestrian access easements and certain Idaho Transportation Department maintenance easements — and to avoid delegating conveyance of city property when the city is the grantor.
Ms. Thornborough, Development Services, told council that many easements follow a predictable pattern and use preapproved templates vetted by the city attorney; staff cited an example where recordation delays slowed a commercial occupancy timeline. Thornborough and Wadhams both said the delegation would apply only when a decision maker (council, planning & zoning or design review) already approved the condition and a template easement is in use.
Several council members supported the efficiency goal but expressed concern about delegating authority for Green Belt and pathway easements — which draw high public interest — and asked to allow mayor‑elect Jacobs to weigh in. After discussion, a council member moved and the council seconded to table the resolution to a date certain (Nov. 24, 2025); the motion carried on a voice vote. Staff said they can return with redrafted language that clarifies scope and preapproval conditions before the Nov. 24 meeting.
