Planning commission approves Saint Joe's Plaza PUD amendment; property owner presses city on parking maintenance

The Dickinson Planning and Zoning Commission on Nov. 1 recommended approval of an amendment to Ordinance 1592 to allow restaurants and limited retail within the Saint Joe's Plaza planned unit development and to clarify that parking spaces along 7th Street West will remain public and be maintained by the City of Dickinson.
City Planner Natalie Berchak presented the staff recommendation, saying staff had not received public comments and recommended approval. "Staff would recommend approval of this rezoning request," Berchak told commissioners.
During public testimony outside the formal hearing, an owner who occupies property adjacent to the plaza said the business has removed snow, restriped and maintained those curbside spaces for about five years and is worried city crews will not provide the same level of service. The speaker said the business hosts more than 100 children for daycare and asked for a written agreement or memorandum of understanding to ensure timely snow removal and safe customer access. "My concern is... the safety and the customer experience," the property owner said.
Planning staff and Public Works noted that on-street public parking would be subject to the city's existing 48-hour parking limit and that private signage in the public right of way is not permitted. Staff said Public Works intends to send a formal letter to the property owner to clarify responsibilities and offered to meet on site. The city also said applicants may provide private snow-removal services for public spaces if they wish; crews will service those stalls as part of normal routes.
Commissioner (S8) moved to recommend approval of the PUD amendment (REZ0082025) as consistent with Dickinson's comprehensive plan, the motion was seconded and carried by voice vote. No formal public comments were recorded during the open public hearing portion.
Next steps: the commission's recommendation will be forwarded per the city's review process; staff said they will follow up with the applicant and Public Works to document responsibilities for on-street maintenance.
