City legal counsel explained the policy change is narrow in scope (water, sewer, sidewalk, multi-use-pathway, pedestrian and ITD easements) and applies only when the city is the grantee and the easement has already been approved by council as a condition of development. The goal is to accelerate applicants’ ability to record and proceed with construction without waiting for a subsequent council meeting.
Council members generally supported the streamlining. Concerns were raised about greenbelt easements; the final policy preserves mayor review/signature and provides a path to return specific easements to council if further scrutiny is needed. City legal counsel said staff will present executed easements to the mayor after staff review and then record them so projects are not delayed by council meeting schedules.
The council voted to adopt the resolution; roll call recorded affirmative votes and the motion carried.
What happens next: staff will use the adopted policy to present finalized easements to the mayor for signature and then record them, except where council retains review for greenbelt or other sensitive easements.
