Council members moved and seconded the amendment to deny rezoning while granting the expanded conditional use; the motion passed with recorded ayes. Council and staff advised the applicant that, once constructed, replacement of the duplex in the future would require resolving the nonconforming-structure status or a later rezoning.
Councilman Wells and other members said they appreciated the applicant’s pledge to keep the property in the family and clarified the decision’s legal limits. The council’s action allowed the applicant to proceed while avoiding a permanent zoning change to the parcel.
