The applicant proposed a two‑story 20‑unit apartment building; staff from Building & Zoning, Planning, Traffic Management and Housing Strategy largely recommended approval, noting the proposal aligns with the Southeast land use recommendations and would create modest, lower-intensity housing compared with what C‑4 currently permits.
The hearing was one of the most highly attended of recent months in the Greater Southeast area. Area commission leaders and multiple residents urged denial, citing neighborhood character, safety, traffic, the potential loss of an informal community green space and a wish to pursue small-scale commercial or park expansion. The Recreation & Parks department described unsuccessful attempts to acquire the parcel for park expansion after contacting the property owner.
The applicant’s agent, Dave Perry, said the site had been vacant for decades and argued the proposed development represented a downzoning in use intensity compared to potential C‑4 development. Staff observed the developer reduced the project from 22 to 20 units to avoid a parking variance and memorialized design commitments in limitation text (including a pitched roof and site-plan commitments).
Council debated community concerns and staff findings before voting; the rezoning and the associated variances were approved by roll call. Council instructed staff to continue engagement with the area commission about park planning and monitoring neighborhood impacts.
