Residents press Lake Elmo on assessment fairness; council adopts 2025 assessment roll 4–1

The Lake Elmo City Council on Oct. 21 adopted the amended final assessment roll for the 2025 Street and Utility Improvements after a public hearing that included an extended resident protest and a vote that carried 4–1.

City engineering staff summarized the 2025 project work in northwest neighborhoods and said final assessments fell roughly 22% below preliminary estimates because of strong bidding. Staff identified and removed one property—9696 55th Street North—that had been incorrectly listed in the preliminary roll because no work was performed in front of that lot.

At the podium, resident Catherine Todd (9961 55th Street North) said a $17,200 assessment plus 5.5% interest over 15 years would be a severe financial burden. Todd described prior city-required septic relocation cost of about $30,000, alleged the project increased runoff onto her private well area and said contractors removed mature trees and damaged irrigation and an electronic dog fence. She asked the council to abate or reduce her assessment, waive interest, provide tax relief for watershed land taken by the city, offset damages, or commit to environmental testing and remediation.

Councilors discussed whether the removed trees were in the public right-of-way and whether contractor liability applied if work extended beyond easements; staff committed to inspect the site and follow up. Council debated whether properties that accepted bituminous curb in prior improvements (2010) should receive a reduction; staff and some council members noted statutory uniformity requirements for assessments and potential precedents.

Council then moved to adopt the amended final assessment roll (Resolution No. 2025-071), removing 9696 55th Street North from the roll. The motion passed by voice vote with a 4–1 tally.

Next steps: staff will inspect reported property damage and report back to council; collection and lien timing will follow adopted assessment procedures.
