Council approves car‑wash variance with conditions after neighbors raise loitering, safety concerns

The Hialeah City Council approved, as amended, a planning‑and‑zoning item that legalizes a longstanding manual car wash at 5350 West 12th Avenue while addressing an unpermitted large canopy and neighborhood complaints about loitering and illicit activity.

Applicant representatives and the property manager said the car wash has existed for decades and that recent owners allowed conditions to deteriorate; the original operator and new prospective operator asked for time and financial leeway to improve the site. Planning staff offered two options at the Planning and Zoning Board: immediate removal of the large, unpermitted canopy with retention of a permitted smaller canopy, or replacement with one legal canopy no larger than the permitted footprint. The council required immediate removal of the larger unpermitted roof. The applicant agreed to remove the nonconforming canopy and to a monitoring period; council added a condition that if criminal activity or code violations continue during a short review window, the business tax receipt/permit could be suspended or revoked and a security plan would be required.

The city and the applicant also agreed to a timeline for follow up: the unpermitted canopy must be removed promptly and the council set a three‑month review window for enforcement and a requirement that the operator engage security or other mitigation if violations recur. The approval includes the condition that failure to remedy violations can lead to revocation of the business tax receipt. Council members stressed the need for clearer property management by the shopping‑center owner and faster enforcement if problems persist.
