North Bend council adopts ordinance vacating portion of Pony Point Road near airport

The North Bend City Council voted Oct. 14 to adopt Ordinance 2084, vacating a portion of Pony Point Road (dedication deed 91-11-0646) and conveying that segment to the Coos County Airport District. The action followed a public hearing and two readings by title only.
City staff told the council the airport district is the sole adjacent owner of the section proposed for vacation and that the roadway has been closed to general public use since Sept. 11, 2001, for airport security reasons. Staff said a sanitary sewer runs through the roadway and that an existing easement will remain in place for that utility. Staff also acknowledged a noticing lapse: the city posted notice at one end of the road but was unable to post the end adjacent to a runway and said they otherwise complied with state law.
During the hearing, the council had no members report conflicts of interest. After hearing staff and closing public testimony, councilors moved to read the ordinance by title only and then to adopt it. The city recorder polled council members and members indicated their support; the motion carried.
The ordinance record lists the city’s dedication deed number (91-11-0646) and describes the segment to be vacated. City staff and the airport district will coordinate on the easement language to ensure continued public utility access for the sewer.
The ordinance becomes part of the city’s record; the council did not identify any appeals or litigation pending at the time of the vote.
