Following an executive session to receive confidential attorney communication under 25 O.S. §307(B)(4), the McAlester City Council authorized a motion directing the city manager to terminate water utility service to Rural Water District No. 7 effective 9:00 a.m. Monday, Nov. 3 unless the manager reaches a satisfactory accord with the district.
City Attorney Hammonds read the recommended motion after the council returned to open session. The motion, moved and seconded in open session, passed on a roll call vote. The city attorney stated no votes were taken during the closed executive session and that an open‑session action was appropriate to authorize the manager to act if negotiations fail to produce a settlement.
The authorization is a conditional enforcement action tied to a pending claim against the rural water district; staff said the council convened under the statute authorizing confidential communications with legal counsel about pending claims. The motion gives the manager authority to cut water service on a specified date and time if there is no resolution.
What’s next: The city manager will continue negotiations with Rural Water District No. 7; if a satisfactory accord is not reached by Nov. 3 at 9:00 a.m., staff are authorized to terminate service per the council motion.
