Council approves TIF for proposed Chef Louie development after public questions over 'but‑for' analysis

The Mitchell City Council on Tuesday approved a tax‑increment financing district to support a proposed Chef Louie development on Commerce Street, a project staff said would include a new 13,000‑square‑foot restaurant and lounge and generate an estimated $2 million in increment over a 20‑year term.
Justin (city/EDA presenter) outlined the proposal’s scope, saying the project’s total estimated costs are about $9.27 million and that roughly $5.45 million of those costs might be TIF‑eligible but would be capped by projected increment revenue. He explained the base valuation and the 20‑year TIF term, noting overlap with County TIF 2 that limits available increment until that county TIF is paid off.
Tom Peterson, attorney for the developer, told council the Frederickson family will be part of management and that bank financing and county TIF payoff timing affect increment availability. "Karen Frederickson is here tonight to also answer any questions," Peterson said.
During public comment, Steve Simpson urged more transparency and a detailed rate‑of‑return analysis to support the project plan’s "but‑for" assertion that the development would not occur without TIF. "If the developer hasn't produced performance statements…we don't have enough detailed financial analysis to make a proper decision," Simpson said, urging the council to require more financial evidence.
Council members asked clarifying questions about the valuation, the developer agreement terms and projections for when County TIF 2 would stop collecting increment. After discussion the council moved and approved the resolution creating TID No.44 and approving the project plan.
The approval advances the developer agreement process; staff said standard developer reporting and certification of costs will apply. No final developer reimbursement payments occur until the developer meets reporting and certification requirements in the developer agreement.
