Tehachapi council adopts rental registration, inspection ordinance with $40 annual fee for small landlords

The Tehachapi City Council on Monday adopted a municipal ordinance requiring residential rental properties to register with the city, name a local contact for complaints, and meet inspection and substandard-condition response procedures. Development services staff said the ordinance’s four main elements are ‘‘a written policy and procedure for inspecting substandard conditions in multifamily housing,’’ a registration requirement with a contact person for each rental property, a good-faith clause requiring owners to make efforts ‘‘to prevent crime and substandard conditions,’’ and a $40 annual flat business tax on 1-, 2- and 3-unit residential rentals. Staff also noted that because the changes are administrative in nature the measure is exempt from CEQA.
After brief public and council questions about enforcement and notification, a councilmember moved to adopt the ordinance and another seconded. The council recorded a unanimous 5-0 vote to adopt the ordinance.
The ordinance was described on the record as proposed TMC chapter 8.72 (rental registration and inspection) and an amendment to business license tax provisions in TMC chapter 5.08. The staff presentation noted a CEQA exemption for administrative ordinances; the council did not request additional environmental review.
Council direction and next steps: staff will publish the registration materials and post the ordinance online for prospective applicants and will implement the registration and inspection procedures described in staff materials. No effective date was specified in the meeting record.
