Council approves street-code waiver for 1729 Maryville to allow conditional-use process to proceed

Public Works Director Mike Crocker presented a street-code waiver request for 1729 Maryville. He explained city code allows council to grant a waiver from street and curb improvement requirements when a lot borders an unopened or unimproved street but has frontage on another improved street. Crocker said the subject lot fronts Maryville (50 feet of road frontage) and borders Wakefield Street which is unimproved; the parcel would not require Wakefield access to be viable.
Crocker said the property is under contract to Trek Properties LLC and that time is of the essence for contract contingencies. He recommended approving the waiver so the applicant may advance to the conditional-use permit process. Council moved to approve the waiver; the motion passed on roll call 5 to 0 (Councilor Stokes, Councilor Ellis, Vice Mayor Joyner, Councilor Harris, Mayor Parton and Councilor Day voting in favor where recorded). The waiver approval does not itself authorize construction — it clears a code-pathway so the parcel can proceed to the CUP review and any required public hearings.
Council asked that staff encourage slightly larger home sizes when communicating with applicants to help align new proposals with neighborhood expectations. Public works and planning will process the waiver and coordinate next steps with the applicant.
