Clay County opens bids for bank stabilization project; late bid excluded under state law

The Clay County Commission opened sealed bids for a bank-stabilization project identified as Structure 14-125-120 and recorded multiple timely bids.
Counsel advised the board that the published deadline for sealed bids was 5 p.m. on Friday, Oct. 10, and one bid arrived after that deadline. "By state law the county cannot open this bid or accept this bid," Speaker 1 said on the record, and that late submission was excluded from consideration. The chair then read aloud the timely bids and amounts from Suma Suma Construction, Civil Construction, 3D Digging, 605 Companies, Finance Construction, and Beaver Construction; staff reported amounts for each bid and said they would take the bids back for tabulation.
County staff said they would verify whether NRCS concurrence is required for award and then return to the commission with a formal tabulation and recommendation. No award was made at the meeting.
Next steps: staff will prepare a bid tabulation, confirm any external concurrence requirements (NRCS), and bring a recommendation to a future meeting. The late bid will not be considered per counsel’s advice.
