The Clay County Commission at its Nov. 5 meeting approved an ordinance at its second reading that organizes five commissioner seats and clarifies appointment procedures. The ordinance specifies five seats (including a newly clarified fifth seat identified as a Clay County commissioner) and sets a process for bylaws and subsequent appointments.
Commissioners clarified language in sections 11 and 12 that planning commission recommendations are advisory and that the county commission retains final authority on zoning and rezoning decisions. County counsel said the planning and zoning commission "brings a recommendation" to the board and the board is free to accept or reject that recommendation.
The board approved the ordinance by voice vote and directed staff to prepare bylaws and notice/application procedures to implement seat assignments. Staff said they will bring proposed bylaws to the commission within the next 20 days so the board can begin accepting applications and make appointments in early January.
No changes to county law were made beyond the ordinance text approved at second reading; publishing and any additional procedural steps required by statute will occur before appointments are finalized.
