Crook County awards Puckett Road overlay contract to Tri County Paving for $473,625

Crook County commissioners on Oct. 15 approved awarding the Puckett Road overlay contract to Tri County Paving after finding the low bidder’s alternate proposal-bond form to be a minor informality rather than grounds to reject the bid. Brad Haynes, Crook County Road Department superintendent, said four bids were opened publicly Sept. 25 and that Tri County was the low bidder at $473,625.
County counsel reviewed Tri County’s bond form and concluded it provided comparable protections to the county’s standard form; counsel recommended treating the variance as a minor informality so the bid would remain responsive and allow the county to proceed to award. The board first voted to deem the bid-bond form acceptable, then voted a second time to award the contract to Tri County Paving and to authorize signing the contract outside the meeting.
Commissioners thanked staff for the competitive bidding process; staff said a notice of intent to award would be sent to other bidders and that those firms would have an opportunity to file a bid protest if they chose. The contract award authorizes county staff to finalize and sign contract documents.
