Schererville plan commission tables Anna Street subdivision over missing stormwater standard

The Schererville Plan Commission on Dec. 1 voted to table consideration of Plan Commission Case 25-12-23, the Anna Street second-edition one-lot institutional subdivision at 143 West Joliet Street, after staff said a required stormwater standard had been omitted from the public notice.

Staff told the commission that a provision on design storm frequencies (Chapter 45, paragraph a) was not included in the materials advertised to the public. On the advice of the town attorney, staff recommended tabling the item and re-advertising to include that paragraph. The missed provision calls for a minimum 25-foot drainage easement from the top of bank on each side of a new channel and prohibits landscaping inside that easement except a narrow filter strip.

Commissioners moved and seconded a motion to table; the roll-call vote was recorded as Miles Long Yes, Tom Kuris Yes, Chris Rack Yes, Bob Kokan Yes, Gary Emig Yes and Tom Anderson Yes. The motion carried 6-0. Staff said the item will be re-advertised and is expected to return to the commission on Jan. 5 for rehearing.

Because the omission affected public notice of the stormwater requirement, the commission did not take further action on the subdivision request. Staff also noted that the petitioner listed for the case was Schererville Town, with James M. Gorman identified in the record as town manager.

The tabling preserves the town’s ability to consider the full set of drainage waivers and ensures the public has notice of the design-storm-frequency provision before the commission acts again.
