Polk County schedules Nov. 5 hearing to determine hearing body for planning appeal RD25-10

Eric Knudson, senior planner for the Polk County Community Development Department, told the board the department received RD25-10 on June 2, 2025, and that on Oct. 16 the planning director found the application did not meet the applicable review and decision criteria and denied it. Knudson said a timely appeal was filed Oct. 23 and that, because the application and appeal are technical and not a matter of countywide policy, staff recommended the board set a public hearing before the Polk County hearings officer rather than hear it as the governing board.
One commissioner (unidentified in the transcript) moved that the board hear the appeal in its quasi-judicial role, citing the property’s long history of decisions and asking the board to examine the Section 3 criteria and past determinations. Another commissioner (unidentified) declined to second that motion, saying the board’s ordinary practice is to refer technical cases to a hearings officer and expressing concern that placing the matter before the commissioners would become, in the commissioner’s words, “a significant circus.” The earlier motion therefore lacked a second.
Board members and staff then discussed available dates, notice requirements and calendar conflicts (including AOC week and Veterans Day). The board agreed to hold a hearing-body determination on Wednesday, Nov. 5, 2025, at 9:00 a.m. Staff said they would follow requisite notice timelines for the selected date.
The board referenced Polk County’s ordinance cited in the record as CZO 111.280 as the authority governing how the board determines the hearing body for appeals. The appellant asserts a legal-status claim that a dwelling should be treated as vested once lawfully established; that assertion was described in the appeal materials submitted to staff and summarized by Knudson.
Next steps: The board will provide public notice and hold the Nov. 5 hearing to determine whether the appeal will be heard by the Polk County hearings officer or by the board. The transcript does not record a formal vote or final ruling on the substantive appeal itself at the Oct. 28 meeting.
