The Dauphin County Planning Commission voted to table a proposed two-lot subdivision by the Charles and Margaret Polk Foundation in Millersburg after staff identified unresolved issues about easements, setbacks, and the status of Evelyn Drive. Tanner (county staff) said the application proposes a subdivision of slightly more than 6 acres for a medical-center parcel but lacks documentation for a requested waiver of preliminary-plan requirements and does not show established utility easements through a residual parcel. Staff also noted that building setbacks were not shown for the portion of the property that falls inside the borough, and that sidewalks are required by the county subdivision ordinance though staff suggested a pedestrian easement as a possible alternative.
The staff presentation noted a 1991 maintenance agreement and deeds that may clarify responsibility for Evelyn Drive but recommended follow-up with the Polk Foundation, the borough, and the township to confirm whether the existing maintenance agreement remains in effect and whether the portion of Evelyn Drive in the borough is a public right-of-way. Planning staff said the county has 90 days under state law to act on the submission and recommended waiting one month for the borough and township reviews to be completed.
Commissioner Joe Robinson moved to table the plan and the motion carried with one abstention recorded (Mary). Staff will request the Polk Foundation provide outstanding easement and waiver justification documentation and will forward the 1991 maintenance agreement to the borough manager for review.
