Board approves process to review KSDE regulations focused on administrative burden and student learning
Summary
The State Board voted unanimously to adopt a new monthly process for identifying and reviewing agency regulations that impose significant administrative burdens, are disconnected from student learning, or strain district resources; staff will present regulations 'article by article' for board direction and final edits.
KSDE presented a stepwise process for reviewing agency regulations: staff will identify candidate regulations, present them monthly 'article by article' with an initial vote on direction and follow-up language edits by program staff, and then bring final edits to the board. Dr. Nugent said staff will prioritize regulations that (1) impose significant administrative burdens on districts; (2) are disconnected from student learning; or (3) strain district resources.
Board member Dennis moved the motion that "the Kansas State Board of Education approve the proposed process to identify regulations for review" under those criteria; the motion specified that program staff would refine language and return for a final board vote. The Board approved the process unanimously (10–0). Several board members stressed that changes in law remain within the legislature's authority and that this process applies to regulations the Board controls.
The Board did not adopt specific regulatory changes at this meeting; staff said they will bring the first regulation under review at the next day's session as a pilot.
