Averell said he took the matter to the tax appeals board, which issued an order recommending relief and stating the county agreed with his assertions but lacked the authority to waive the penalty. He asked the county commission to waive the penalty now that the tax principal had been brought current.
County officials asked for a copy of the tax‑appeals order and related documentation; Averell said he would provide a copy. Commissioners agreed to review the tax‑appeal paperwork and consult with staff and the county attorney, and they deferred a final determination pending review and possibly the attendance of additional county officials.
