Kevin Eldon, counsel for the applicant, told the council the company sought relief because a 40‑foot flagpole would be more visible above existing warehouses and trees and would serve government clients that travel Route 40. Eldon said the applicant focused on showing practical difficulty under the variance standard and that no neighbors objected during the hearing record.
Owner Mike Watts and an employee who testified at the hearing described the business's military contracting clientele and the visibility purpose of the flag. Eldon noted the construction cost of the flagpole is not insignificant and referenced other local sites with tall flagpoles as context.
The chair reminded participants that the final argument must be based solely on the hearing record and that no new evidence could be introduced at the appeal. After the presentations the council concluded the argument and held the case for a future decision; no vote was taken that night.
