Taneytown considers removing routine fence permits; commission debates enforcement and notice

Staff presented a proposed text amendment to streamline fence regulation by eliminating routine fence permits except where a fence would occupy a city easement and would therefore require written notice. Under the draft, fences that do not cross easements would still be required to meet the code's dimensional, height and clearance standards, but homeowners would not need to secure a $10 administrative permit.

Several commissioners and residents cautioned that removing the permit requirement might reduce public awareness about setbacks and stormwater clearance requirements and could increase after‑the‑fact enforcement work. "If they put the fence up over the weekend ... we're going to go back out and tell them they need to alter it," one commissioner said. Staff replied that eliminating permits would reduce staff time for low‑risk permit reviews and that the city would provide clearer written guidance and easement forms where needed; enforcement would remain complaint‑driven.

Commissioners requested a short printed guidance sheet or online checklist residents could consult to ensure fences meet code requirements if permits are removed. The item will return with draft language and a public outreach plan for notifying property owners about the change.
