Committee continues rooftop-appurtenance ordinance for C3 zoning to Nov. 16

The Land Use and Transportation Committee voted to continue consideration of an ordinance that would change how rooftop appurtenances are measured in C3 zoning and create a review process to authorize certain types of infill floor area on nonconforming buildings. The committee set a new hearing date of Monday, Nov. 16, and requested a stakeholder briefing with Planning staff before then.
Aaron Starr of the Planning Department said the ordinance would allow rooftop appurtenances and enclosure of certain rooftop areas on buildings that are legally nonconforming with respect to height in the C3 district. He said the proposal was prompted by plans at 1095 Market Street (the Yotel) and that a GIS search suggested the change could affect more than 200 buildings downtown that became nonconforming after the 1985 downtown plan.
Supervisor Jane Kim said her office had not received a prior briefing and moved to continue the item to ensure stakeholder involvement; she explicitly requested that Planning meet with her office and other interested stakeholders before the Nov. 16 hearing. During public comment, an attorney for Local 2 asked the committee to continue the hearing because project plans for 1095 Market Street were not readily available on the Planning Department website and needed time to be reviewed; other speakers, including Jim Abrams, spoke in favor of the ordinance as a tool to help rehabilitate historic downtown buildings.
On the motion to continue to Nov. 16 and request a stakeholder sit-down, the committee voted by roll call and the continuance passed unanimously.
