The Uxbridge Conservation Commission closed the public hearing on DEP file 3121185 for 404 Blackstone Street and voted to issue the town's standard order of conditions and a Chapter 2.90 stormwater management permit, contingent on a bond acceptable to the town and a maintenance agreement.
Tom Corbett of 0 Point Development (ZP Battery DevCo) presented revisions including changes to erosion-control wording and a phasing plan to ensure seed irrigation across both phases. Commissioners raised specific concerns about the emergency spillway that would overflow to the street during an extreme event and sought assurance that the detention basin and spillway meet stormwater handbook requirements and local regulations.
“One of the concerns was that under an extreme event the emergency spillway could end up in the street,” said Speaker 3 (Unidentified commission member), who asked whether the design provides a numerical threshold (for example, up to a 4-inch or 5-inch storm) that the basin can safely contain. Corbett said calculations and design details are included in the package for the commission and are being reviewed by town staff and the agent.
Commissioners also discussed a bond estimate and basin maintenance. Corbett estimated the detention-basin bond could be “somewhere around” $5,000 by comparing to a recent similar project; staff said the final bond value would be determined and provided to the commission. The motion to issue the order of conditions passed; the motion to issue the stormwater permit was approved 3–1 with the condition that a suitable bond be in place before permit issuance.
Next steps: staff will finalize a recommended bond amount and include maintenance terms; the permit will be issued only after the applicant secures the bond and meets standard conditions.
