Sen. Ken Bogner introduced Senate Bill 124 to the House Judiciary committee, asking that protections established by a recent Supreme Court ruling — that displaying an electronic driver's license does not constitute consent to search an electronic device — be extended to all licenses.
"A few years ago, the Supreme Court had a ruled on a decision that stated displaying an electronic driver's license or handing it to a peace officer did not constitute consent to search and seizure of that device," Bogner said. He said his prior bill codified that holding only for driver’s licenses, and SB124 expands the protection to other types of licenses as more documents move to digital formats.
The sponsor offered to answer questions; no proponents or opponents registered online in the hearing record, and the committee closed the item after the senator’s brief presentation.
Bogner closed by asking for the committee's support and thanked members for a quick hearing.
