Bill to separate marijuana and alcohol possession for minors moves to committee hearing

Sen. Tom McIlver introduced Senate Bill 132 to the House Judiciary committee, saying the measure would separate existing minor‑in‑possession (MIP) language so officers and courts can distinguish marijuana from alcohol and other intoxicating substances.
McIlver told the committee the bill does not alter penalties. "We added two new sections — section 1 for alcohol and section 2 for marijuana — so by delineating marijuana and alcohol separately, we can now track them," he said.
Tom Belteen, bureau chief for Youth Court Services at the Office of Court Administrators, testified in support. He said the change would allow law enforcement citations to indicate which substance was involved and permit youth court and justice court data systems to capture that detail from the point of contact. "This will go a long way for our office to better track the specifics with regards to alcohol, marijuana, and other substances," Belteen said.
Committee members asked how the change would interact with existing sanctions, including community service and driver’s license suspensions. McIlver emphasized the bill "does not change any of the current law" and only creates separate coding so agencies can report substance‑specific counts.
With proponents and clarifying testimony concluded, the sponsor closed by saying better data on youth marijuana use, especially given higher THC products, is important to understand impacts on youth and urged committee action. The committee closed the hearing and moved on to the next item.
