Bill to align state law with federal Electoral College meeting date wins proponent support

Representative Morgan Thiel presented House Bill 380 as a straightforward cleanup requested by the Secretary of State’s office to bring Montana statute into alignment with federal law that moved the Electoral College meeting date to the Tuesday after the second Wednesday in December.
Austin James, representing Secretary of State Christy Jacobson, said the statutory change prevents constituent confusion because, without it, state code would state a different day than federal law requires. Amy Grama of Secure Democracy also testified in support and asked for a due pass.
Committee members asked about when the federal change occurred; witnesses said the federal change took place in 2022 and has been effective since the last session. Representative Teal closed in support and urged a due pass. The committee closed the hearing on HB380 and later advanced other business.
