Representative Steve Gist introduced House Bill 6 16 to allow predictive data modeling to supplement physical sediment and water sampling when operators seek bond release after reclamation. He said modeling can provide robust drainage‑wide soil and sediment load estimates without the logistical and financial burden of exhaustive sampling.
Industry witnesses (Westmoreland Mining, Montana Coal Council) supported the bill, arguing the approach is modern, publicly available, and cost effective. "All we're dealing with here is currently... we're required to physically sample... This simply allows us to reduce the number of physical sampling sites, build a model that would predict the outflow," Daryl James said.
Opponents, including Tom Baratta (Bull Mountain Land Alliance) and the Montana Environmental Information Center, said models show projections, not on‑the‑ground realities, and warned that models can be opaque and manipulable. They urged statutory guardrails: public access to model assumptions and data, rulemaking or standards for acceptable models, and mechanisms for recourse if models are inadequate. DEQ's Dan Walsh said modeling would be an "additional data point" and would not supplant field inspections or other evidence used in bond release decisions.
