Uxbridge board approves bond-substitution for Lejmere Country roadwork contingent on closing and re-estimate

The Town of Uxbridge Planning Board approved, with conditions, a developer-requested substitution of subdivision surety tied to the Lejmere Country subdivision.
Outside counsel Jeff Roloffs said developer Fafford intends to sell sections of the Lejmere Country project and asked the board to accept a replacement bond for the upper Crown Shield segment, with the buyer (TMD) securing a bond for the same amount currently held for the entire roadway. Roloffs said the substitution would, in effect, result in two bonds covering the two roadway segments rather than a single bond.
Board members repeatedly questioned whether the existing bond amounts — set years earlier — remain sufficient given current construction costs. Planning staff and members recommended that Graves perform a re-estimate of the work to confirm whether the split bonds provide adequate surety. The applicant (Fafford) and the buyer (TMD) agreed that either party would cover Graves' time for a rebonding analysis and that the substitution would be contingent on the buyer closing and providing the new bond instrument.
After a brief recess to reconsider an earlier vote, the board approved the substitution motion contingent on closing and delivery of the new surety and asked staff to have Graves evaluate the adequacy of the amounts for upper and lower Crown Shield. Tim Bobala of TMD (Bella Construction) introduced his company and outlined past local projects. The board expressed willingness to have Graves return with a revised cost estimate and reserved authority to require a higher bond if Graves recommends it.
What happens next: the board will require formal documentation of the bond substitution, Graves will be asked to estimate remaining improvements for both roadway segments, and the substitution will only take effect after the buyer closes and provides the replacement bond.
