Panel backs bill to codify dental anesthesia inspections into statute

Representative Ed Buttry told the committee HB584 is a housekeeping bill to give the Board of Dentistry the statutory authority to perform anesthesia permitting and inspections, aligning statute with rules the board has already promulgated.
Sarah Swanson, commissioner of the Department of Labor and Industry, said the department inadvertently promulgated a rule that extended beyond its statutory authority and that passage of HB584 is needed to preserve existing inspection practice. She provided data showing 927 licensed dentists in Montana and 89 outstanding anesthesia inspections across categories (deep/general, initial, reinspection), and said the department hires dentists to perform those inspections under contract.
Deputy chief legal counsel Jennifer Stahlkamp and representatives of the dental community urged passage to protect patient safety and preserve inspections. Industry speakers also asked the committee to consider separate modernization amendments to outdated statutory language about ownership and practice definitions; proponents said such scope amendments would change the bill's support.
The committee voted to pass HB584 and move it to the floor; members discussed forming a small group to evaluate proposed title/definition amendments before any floor amendment.
Next steps: HB584 was advanced to the Senate floor; DLI and the board will continue rulemaking and contractor procurement to complete outstanding inspections.
